I was playing UoP, and had beaten the Spartins into surrender. Several turns later, I was just moving a transport destroyer through their territory (to drop of some "goodies" in believer territory) and they accused me of an atrocity (and all the other factions severd pacts\treaties with me). I am a little confused as the transport and its cargo (mindworms) did not have atrocity capability. Thoughts?

More likely, you committed the atrocity earlier that turn or a couple turns before, and this was the first time a Spartan unit was adjacent to one of yours.
The AI players are much more likely to talk to you when one of their units is adjacent. I suspect this is at least partially to reduce the times somebody declares Vendetta on you while they are half of Planet away.
